Focusing on Gratitude

This month we are focusing on gratitude! Thanks to our many clients who choose to be Drug Free and make our communities a better place to live. This month we are especially thankful for Orion Industries. This non-profit provides job-training and job opportunities for employees who may have had barriers to meaningful work in the past. Orion trains, mentors and provides ongoing guidance after the trainees have been placed in manufacturing and customer service jobs. DOT DER question of the month:
Under FMCSA, what is a voluntary disclosure of a drug or alcohol problem and how should an employer respond to that disclosure?
 
When an employee voluntarily discloses to their employer they have a substance abuse disorder, under a voluntary disclose plan before an employer observes suspect behavior, before being selected for a DOT drug test or before having a positive DOT drug test, this is not the same as having actual knowledge requiring the employer to report the violation to the FMCSA Federal Clearinghouse.
 
This action, when taken in good faith, by the employee is not a violation of the employer’s policy thus allowing the employee to get the help he/her needs through a last a chance agreement and/or EAP services, if available.
 
Make sure your employee training materials and company policy clearly state how and when an employee can disclose a substance abuse disorder in order to seek treatment and not be in violation of the DOT policy. For the actual regulation go to CFR 382.121.
 
The question about when and/or if you can test employees for marijuana for NON-DOT employees has become increasingly complex and is dependent on which state(s) your employees are located. Not sure?

Effective January 6th, 2023, the Federal Drug and Alcohol Clearinghouse is 3 years old. As an employer, you will now be able to do be able to do your 3-year pre-hire drug and alcohol background query exclusively on-line for CDL drivers who fall under FMCSA at the above website.
 
Also don’t forget to do your annual employee queries and all random selections before the end of the 4th quarter.
 

Here are some tips on how to politely decline or to limit alcohol when celebrating with friends and family. Click on the picture above for alcohol awareness information for your employees.

Be busy. Hold a non-alcohol beverage in hand, while mingling at the party or offer to help the host or hostess.

Be present. Be interested, engage with people and enjoy yourself. Honestly, most people won’t even notice or care if you are drinking alcohol or not.

Be ready. Bring your own beverage and know what you’re going to say in advance. Offer to be the designated driver or say you have an early day tomorrow, or even simpler, just say no thanks, no explanation needed.

Be honest. If you or a loved one is struggling with alcohol, you may want a trusted family or friend to be there for you or consider confidentially reaching out for help.
